By purchasing a raffle ticket from Meals on Wheels of Albuquerque (MOW), the purchaser agrees to the following terms and conditions:
RAFFLE TICKET ORDERS The price for each raffle ticket is $10. Any prize awarded with respect to any ticket will be awarded to the person named on the raffle ticket order form. The person named on a raffle ticket order form cannot transfer by sale, gift or other means any interest in the ticket, any attempted transfer shall be null and void, and MOW shall not be required to honor any such transfer.
MOW is not responsible for lost, misdirected, late, non-delivered, or other failed efforts to submit a timely ticket order. All ticket orders must be received and fully paid prior to each respective drawings in order to be valid. The IRS does not consider the purchase of a raffle ticket to be a tax-deductible charitable contribution. Please consult a tax adviser for personal tax matters.
All sales are final. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
ELIGIBILITY The MOW Raffle (the “Raffle”) is open only to legal residents of the United States who are at least 18 years or age.
WINNING THE PRIZE Winner need not be present at the drawing; winner will be notified by phone and/or email. MOW will make reasonable efforts to contact the persons named on a winning raffle ticket order form, using only the information on the winning raffle ticket order form. All prizes must be claimed by winner within thirty (30) days from date of drawing. The person named on a winning raffle ticket order form agrees, as a condition to being eligible to receive any prize, to provide written information as is required by any applicable tax laws, including without limitation his or her Social Security Number and proof of identity in forms satisfactory to MOW showing that the person claiming the prize is the same person who is named on the winning raffle ticket, and to complete, sign and deliver such withholding, certification and other forms as may then be required by the IRS and other governmental agencies. MOW shall be protected and may rely in its sole discretion any information on it provided to it by the person presenting a winning raffle ticket to confirm that the person is the person identified on the ticket
WINNING THE RAFFLE MOW does not provide any guarantee, agreement, representation or warranty, express or implied, in connection with the prize packages. All prize winners are solely responsible for paying and reporting, as and when required by law, all income taxes and any other taxes and expenses attributable to the prize, and shall indemnify, defend, protect and hold harmless MOW against all claims relating to such taxes and expenses.
LIMITATION OF LIABILITY/HOLD HARMLESS AGREEMENT Each person who purchases a raffle ticket and/or whose name appears on a raffle ticket order form: (a) acknowledges and agrees (for himself/herself and for every successor in interest) that the terms stated in this instrument are also conditions of MOW’s obligations hereunder, and that any obligation of MOW is limited solely to its undertaking to provide a prize to the winner of the drawing as herein provided, subject to the stated terms and conditions, and that MOW shall in no event be subject to any other obligation or liability, including but not limited to, any consequential, special or punitive damages of any kind; (b) agrees that MOW, its directors, officers, employees, agents, representatives are not responsible for any injuries, losses or damages of any kind arising in connection with, or as a result of, this raffle and/or that person’s failure to win or redeem any prize, or that person’s award of, acceptance of, or use of, any prize; and (c) releases and agrees to indemnify, defend, protect, and hold harmless MOW its officers, directors, employees, agents, sponsors and affiliated entities from and against all losses, damages, rights, claims and actions of any kind arising in connection with, or as a result of, this raffle and/or that person’s failure to win or redeem any prize; and (d) represents and warrants to MOW that he/she has read and understands these Rules and agrees to be bound by these Rules and MOW decisions, which will be final.
